- Abstract
The article analyzes the prospects of the U.S. Supreme Court's decision in the case Berghuis v. Thompkins. It informs that in its decision, the Court ruled that a suspect who wishes to remain silent must do so but failing to which may result in an implied waiver of that right. It mentions that the Court found that defendant Thompkins failed to invoke his right to remain silent during interrogation and thus his three affirmative responses to questions were admitted against him at trial.
