- Abstract
The Second Chamber of the Supreme Court of Justice of the Nation in Mexico determined that the regulations governing the legal deposit of publications do not violate copyright laws. The company Alternativa Representa, S.A. de C.V. argued that these regulations disregard authors' rights regarding the availability and reproduction of their works. However, the ruling concludes that Article 39 of the General Library Law does not violate authors' rights. According to the General Library Law and the Federal Copyright Law, depositary institutions are obligated to receive and preserve published works for public consultation, but the delivery of the works before their distribution is not required.
