- Abstract
The article examines the applicability of § 1004 para. 1 BGB (analogous) as a legal basis for claims for injunctions by individuals affected by the processing of personal data against a data controller. It is determined that the GDPR blocks claims for injunctions regarding the processing of personal data under national law. The question of whether § 1004 para. 1 BGB (analogous) is suitable for enforcing claims for injunctions based on the GDPR is also examined. It is emphasized that the Federal Court of Justice (BGH) does not see a general right to injunctions in Art. 17 para. 1 GDPR, but only the right to deletion of certain search results. The Administrative Court of Wiesbaden holds the view that legal acts of the Member States could be considered as "rights arising from this Regulation" within the meaning of Art. 79 para. 1 GDPR. The Higher Regional Court of Frankfurt, on the other hand, rejects this and argues that the GDPR does not allow for substantive claims under national law. It is determined that the GDPR includes the right to deletion of data according to Art. 17 para. 1 GDPR and therefore contradicts a claim for injunction under § 1004 para. 1 sentence 2 BGB (analogous).
