- Abstract
The article "State liability for faulty financial market supervision" analyzes the discussions about the exclusion of BaFin from official liability in connection with the Wirecard scandal. It examines whether BaFin's liability is legally exempt from sanctions and whether such an exclusion of liability is compatible with Union and constitutional law. The article also addresses individual protection in financial market law and the exclusion of liability in detail. It discusses whether state liability is sufficient in the event of problems or insolvencies of banks and other financial market participants. It refers to the investor scandal surrounding P&R and the Wirecard disaster as examples of possible supervisory errors by BaFin. It also addresses the discussion about the compatibility of the liability exclusion with higher-ranking law.
