- Title
ISLAM IN THE SECULAR NOMOS OF THE EUROPEAN COURT OF HUMAN RIGHTS.
- Authors
Danchin, Peter G.
- Abstract
The article examines the effects of the controversies involving Islam and the role of Islamic norms in European nation-states on the European Convention on Human Rights (ECHR) jurisprudence. It argues that these controversies cause significant disturbance to the existing normative legal categories embedded in the ECHR and raise some issues concerning the scope and nature of the right to freedom and religion. It also explores how the European Court of Human Rights interprets the two legal norms and how Christianity influences the state law.
