- Abstract
The article examines the consequences of reforms based on the functionalists assumptions when the outcomes fails to achieve the desired goal in the U.S. It mentions that the Andean scholarship shows that its failure entails the danger of subsuming the result of prescriptive utopia of Comparative Community Law. In this regard, it contributes the methodology of comparative problem-solving from the legal model of European Union to address the problems.
