- Abstract
The article discusses the necessity of fee-shifting statute in eminent domain cases and the attorneys' fees in Georgia. It presents a review on just compensation requirement in the state, its condemnation procedure, and its limited statutory authorization for a landowner that recovers attorneys' fees in condemnation cases. The approaches to fee-shifting statutes in eminent domain proceedings employed by the state and other states in the U.S. are also discussed.
