- Title
STAYING TRUE TO THE IDEALS OF FUNDAMENTAL FAIRNESS: AN EMPIRICAL STUDY OF THE DISSENTS OF JUDGE STRAUB.
- Authors
Levine, Danielle L.
- Abstract
The article discusses the U.S. Court of Appeals for the Second Circuit cases to evaluate dissenting opinions of judge Chester J. Straub regarding fairness, integrity or public reputation of judicial trials including Rosario v. Ercole, United States v. Cavera, and Taravella v. Town of Wolcott. In Cavera case, a district court decided that in areas with strict gun laws, gun ownership is low hence penalty in such areas should be higher, however Straub viewed the decision unreasonable.
