Validity of a Municipal Designation.
- Abstract
The article examines the legality of a municipal designation in Italy, known as DE.CO., and its compliance with EU law. It explains that regional laws cannot establish marks or designations of origin that restrict the free movement of goods. The DE.CO. designation is classified as a simple geographical indication that does not certify the product's quality but rather indicates its connection to a specific territory. The article concludes that the DE.CO. designation does not introduce restrictive measures and is not in violation of EU law. The text also discusses a legal case challenging the constitutionality of regional provisions in Sicily, but the court finds the petitioner's arguments to be inadmissible. Additionally, the article provides an overview of Sicily's Law No. 3 of 2022, which regulates the establishment of DE.CO. designations to protect and promote local agricultural and food products, crafts, biodiversity, and cultural heritage. It also mentions the European legislation governing quality schemes for agricultural foodstuffs and the protection of geographical indications and designations of origin.
