- Abstract
This article examines whether sexual freedom should be dependent upon the location in which the sexual activity occurs. The author argues that what should matter is not where a sexual act takes place but whether the partners expectations of privacy are reasonable. Part one of this article begins with a brief discussion of the critique, as well as the views of some queer theorists. Part two researches the public sex literature. Part three discusses the Due Process Clause and the right to sexual freedom.
