- Abstract
The article examines the ruling of the U.S. Court of Appeals Second Circuit in the case Burda Media Inc. versus Viertel concerning burden of proof of service. Burda Media Inc. claimed that defendant Christian Viertel and other conspirators attempted to defraud the company by submitting false invoices. The court held that the burden must be allocated to the defendant. It argues that the court adopted a test that could cause severe hardship to potentially innocent defendants.
