- Abstract
The article focuses on professor Neil MacCormick's institutional theory of law, miscarriages of justice in criminal trials and the statutory basis for appeals in Australian criminal cases. Topics discussed include the legislated right of appeal and its interpretation and application by the Australian appeal courts, the grounds of appeal legislation and amendment of the right of appeal and a comparison of Australian and Great Britian appellate cases.
