- Abstract
The article focuses on the analysis of the Australian identity theft laws which forbid the possession of personal information aimed to commit further crimes. It notes that the criminal law must avoid the use of status offences such as possession except when the nature of the item possessed is essentially harmful. It cites the need for the description of activities which must be prohibited to avoid identity crimes. It adds that legislatures must justify the criminalisation of incipient behaviour.
