- Abstract
The article offers information the history, purpose and procedures for filing the state and federal summary judgments process in Texas and other states of the U.S. It discusses various types of cases amenable to summary judgments including statute of limitations, res judicata and collateral estoppel, and medical malpractice. Topics also discussed include the burden of proof for summary judgments, attorney's fees, and the significance of the expert witness testimony.
