- Abstract
While labor relations express the relations between the employee and the employer, it is seen that the employees in managerial positions, to whom the employer has delegated some of their authority, are included in the system with the effect of the increase in capacity. It can sometimes be difficult to determine exactly where this ruling class will be included. People in managerial positions are generally considered to be employees because they work under an employment contract, but they are also close to the employer because they act on behalf of the employer. In addition, when job security provisions come into effect, it is important to determine how the employer should act in the termination of the contracts of these employees in the light of the regulations in the legislation. In this context, in our study, based on the provision of the Labor Law No. 4857 that employer representatives with certain qualifications cannot benefit from job security provisions, employer representatives will be explained and their situation in terms of job security will be examined.
