ASSESSMENT OF NEW FACTS PRESENTED AFTER THE TRIAL IN CORFU CHANNEL CASE.
- Authors
IBRO, Enio
- Abstract
This paper will focus on two important matters which are relevant to discuss after new facts emerged many years after the International Court of Justice verdict; the desclassification from the government of the United Kingdom of XCU/XCU1 secret documents and various research results from the cooperation between the Institute of Archeology of the Center of Albanological Studies and dhe RPM Nautical Foundation which scanned the waters of Saranda Bay in 2007. The new discoveries make it an obligation the revaluation of the objectivity of the Court's verdict. At least to respecify the exact location and the purpose of the British warships entering the territorial waters of Albania. In the Corfu Channel incident, one of the major aspects of the dispute was whether the warships of United Kingdom's Royal Navy passing through the Channel of Corfu had innocent intentions or hid something obscure. This paper will analyse the impact of the new facts and try to shed light in one of the most fascinating cases of international law.
