- Abstract
Freedom of expression is one of the foundations of every democratic society. It is one of the basic human rights and is fundamental for the enjoyment of other human rights. Freedom of expression is applicable not only to ideas and information that are favorable, but also to those that offend, shock or disturb. However, there are some forms of expression that are not protected under this freedom. This means that freedom of expression can be restricted. Any restriction on freedom of expression must meet the three-part test under international human rights law: that it is to be prescribed by law, to serve to protect a legitimate interest recognized under international law and to be necessary to protect that interest.
