- Abstract
This article focuses on the judicial decision made by the Appellate Court of Florida against the case "Sires v. State Fire & Casualty Co., 226 So.2d 825," concerning laws related to uninsured motorist claims. It is clarified that, where insurer of party involved in automobile accident became unisured more, than one year after the accident, the other party was not eligible to recover under uninsured motorist endorsement because of one year insolvency limit contained in FSA § 627.0851 (2) and (3), notwithstanding five year statute of limitations applicable to contract actions.
