- Title
Cancellation of Generic Incontestable Marks.
- Authors
Borzcik, Joni
- Abstract
The article reports on the move of Lanham Act to look for petitions to cancel the registration of marks to have become generic in the U.S. It notes the need of the Act to offer a strong echo of the doctrine that most courts and the Patent and Trademark Office (PTO) have adopted for the cancellation of long-lived registered marks since the Lanham Act was enacted. It infers the cancellation of the mark's registration if the non-generic aspects of a mark have been abandoned.
