- Abstract
The article proposes three types of proof that U.S. courts should accept as evidence of institutional indifference in Eight Amendment prison conditions cases for injunctive relief. Topics discussed are application of Eight Amendment jurisprudence to prison conditions, suit against state prison systems and the Federal Bureau of Prisons for injunctive relief, constitutional protection provided by the Eight Amendment to punishments, and proposed evidentiary framework for prison conditions claims.
