- Abstract
Spain's regional governments assume legal guardianship of unaccompanied non-national minors who are deprived of parental care. Article 35.11 of Basic Law 4/2000 of 11 January on the rights, freedoms and social integration of non-nationals in Spain ("Basic Law 4/2000") introduced an innovative mechanism through which "non-governmental organisations, foundations and entities committed to child protection" can assume such guardianship if the General State Administration and the regional governments sign agreements to that effect. But that provision does not stipulate what these agreements should contain and how they should be regulated, providing only minimal detail. Nor are there administrative precedents or case law on how article 35.11 of Basic Law 4/2000 is to be interpreted or applied. This article aims to identify the essential elements for this mechanism to function and be legally viable.
