- Title
FULLER'S CONCEPT OF LAW AND ITS COSMOPOLITAN AIMS.
- Authors
Viner, S.
- Abstract
The article focuses on the author's clarification regarding Lon Fuller's concept of law and its cosmopolitan aims based on the claim of David Luban. Commentators particularly Luban said that for Fuller the activity of law is a moral activity and his principles of legality are moral excellences. The author clarifies that Fuller is only attempting to discover the activity of law in human effort. Luban objects on the claim of Fuller that the activity of law contains cosmopolitan aims since this cosmopolitanism does not follow from the Fuller's concept of law. The author clarifies that Fuller provides good reasons for not including cosmopolitan aims into the morality inherent in the law.
