- Abstract
The article discusses the author's claim that the Georgia Supreme Court should clarify that the apportionment of liability statute requires defendants to identify nonparties, and that the defendants must allege and present evidence on all elements of a cause of action in order to include a nonparty on a verdict form that allows a jury to apportion fault to a nonparty as of 2016. Legal interpretations and precedent are examined, along with the due process case Double View Ventures LLC v. Polite.
