- Abstract
The court, however, held that the contract and the specifications were not in conflict with one another because the contract itself was silent on the issue of a cure period; in other words, the court ruled that the time period from the specifications served to supplement the contract. A significant amount of case law exists addressing the application of pay-if-paid and pay-when-paid clauses in construction contracts. While the specific findings of the trial court were somewhat unclear from the Court of Appeals' decision, the Court of Appeals suggested that Conway (despite denying wrongdoing) did not neglect to or refuse to correct the allegedly deficient work.
