- Abstract
The article offers information on the judicial decision of the First Judicial Department of the Appellate Division, New York Supreme Court in the case of People v. Encarnacion, in which the Court affirmed the trail court's decision regarding misconduct by defendant Samuel Encarnacion, and the witness Ofelia Torres refusal to testify at trial. The defendant claimed that prosecution's use of a grand jury testimony from DNA tests violated his right to confront a witness under the Sixth Amendment.
