- Abstract
The article explores the Ohio Data Protection Act that allows covered entities who comply with certain data protection frameworks to take advantage of an affirmative defense for wrongful claims following a data breach. It discusses the benefits of the act including the scalable approach and protection of consumer data through cybersecurity measures and consumer access to litigation. It discusses the data breaches in U.S., the provisions of the act, and the effect of the act on other states.
