- Abstract
The article provides information on the issues concerning the problematic tort of the intentional infliction of emotional distress (IIED) in the U.S. It traces the emergence and evolution of IIED in the American legal system and the limitation that distorts the common law antecedents of IIED. Furthermore, the later part of the article explores the position of IIED in the analytical framework of tort law including the practical and theoretical problems that account for the judicial impulse to curtail the availability of IIED.
