- Title
FROM WARDS COVE TO RICCI: STRUGGLING AGAINST THE "BUILT-IN HEADWINDS" OF A SKEPTICAL COURT.
- Authors
Hart, Melissa
- Abstract
The article discusses the development of the disparate impact provisions of the Civil Rights Act of 1991 in the U.S. It highlights the effects of the court's decision in Wards Cove Packing Co. v. Atonio and Ricci v. DeStefano court cases on the interpretation of disparate impact law. It also notes that both court cases created a standard for proving discrimination and the rulings reflect the reality that Justices consider discrimination against whites as the most serious discrimination problem.
