- Abstract
The article describes the historical development of guardian ad litem and assesses the role played by wealth, property, and status in recognition of children's rights. It highlights the roles of class and race in development of laws governing family and describes that guardian ad litem treats children of poor and minority families differently. It reflects that the guardian ad litem is ill equipped to protect the rights of a child and that an express-preferences lawyer is the better model.
