- Abstract
In this article the author discusses aspects of the treatment of the U.S. criminal justice system of rape and the treatment of the asylum adjudication system of gender-based claims. She says that the U.S. criminal justice system protects the rape victims by punishing the perpetrators through successful prosecution using U.S. rape laws. Meanwhile the asylum system protects rape victims by giving them refuge in U.S. territory away from the perpetrators in their countries.
