The new tax reform law may make nonqualified benefit plans attractive to key executives in the future. The author discusses how life insurance can be used to ‘fund’ nonqualified benefits under the new law and allow employers to recover the cost of the nonqualified benefits upon the executive's ultimate death. The tax implications under the new law also are discussed.
