- Abstract
The article discusses the contribution of the European Courts in the development of the norms within the international law. It presents the ruling of the European Court of First Instance on a case between Yassin Abdullah Kadi and the Council of the European Union (EU) and Commission of the European Communities which affirmed the absence of right of an individual residing in EU members states to a fair trial due to the blacklisting of the United Nations (UN) Security Council. It also examines the relevance and implication of constitutionalism in Europe.
