- Abstract
The article describes the facts and background of ECJ's decision in the Alemo-Herron and discusses the teleological interpretation of the Directive on the Transfer of Undertakings and the new purpose that the Court read into this Directive. Topics discussed include the ambivalent fate of minimum harmonisation after Alemo and the Alemo judgment which concerns the interpretation of Directive 2001/23/EC aimed at protecting employees' rights in the event of transfers of undertakings.
