- Abstract
The International Criminal Court (ICC) is seeking arrest warrants for Hamas leader Yahya Sinwar and Israeli Prime Minister Benjamin Netanyahu on charges of war crimes and crimes against humanity. The ICC's chief prosecutor, Karim Khan, distinguishes between the crimes committed by Hamas and Israeli leaders, stating that Netanyahu's actions for "total," "absolute victory" are in violation of international humanitarian law. External international legal experts have confirmed Khan's findings against Israel and Hamas. However, Israel and the United States have rejected the ICC's legitimacy and strongly oppose Khan's position. The ICC has no police force and relies on states to arrest fugitives. The tension between national subjectivity and international objectivity is highlighted in this case, as it is the first time the ICC has targeted a Western democracy or the top leaders of a close U.S. ally.
