- Abstract
The article discusses the legal provisions which led to the decision of the court in the case "State v. Washington Educational Association (WEA)." The conflict emanated when the State of Washington and two of its employees decided to sue WEA after finding out that the organization failed to meet the requirements of the state law regarding the use of affirmative authorization to nonmember agency fees for political purposes. Despite the justification provided by WEA that nonmembers were provided with the opportunity to object, the court sided with the complainants. The decision of the court was anchored on a statutory law which states that a labor union's use of agency fees paid by non-union members for political purposes is unconstitutional.
