- Abstract
The article discusses bankruptcy and its relationship with regulated industries, the misconceptions about the effect of bankruptcy on regulated entities and investigates whether bankruptcy might make a positive contribution in the utility area. It emphasizes bankruptcy's possible role for the electric utility industry and supplements pure bankruptcy-administrative law considerations with an exploration of the relationship between bankruptcy and the circumstances underlying the current nuclear power plant crisis. It points out that as nuclear utilities have used the fear of bankruptcy as a scare tactic to shape the political environment where they operate it suggests the need to analyze in detail the benefits and burdens of bankruptcy.
