- Abstract
The new solutions of the Law for Justice for Children had underlined the role of informal forms of treatment giving opportunities to take into consideration the opinion and consents of the victim in the further application of certain procedures. These informal forms of treatment are not burdened with formalities. Restorative justice promotes diversion model for avoiding criminal procedure with the purpose to dodge the possibility of forming a criminal record for smaller offences, if it is likely that the child can be re-socialized. Restorative justice is understood with great skepticism due to the argument that all parties will seek final solution from the courts. Common cases include evaluation of restorative justice as a path that avoids criminal liability, which sentenced in advance the possibility of positive outcome of the procedure without taking into account the advantages it provides. In this sense, the modest purpose of this paper is to define and elaborate restorative justice and the restorative procedures according the Law for Justice of children. Also we will analyze the real implementation of restorative justice during 2014 trough statistical data in order to see if the implementation was successful enough and to discover whether the ambitions for its revival are only theoretical or there is a possibility for real affirmation through the criminal justice system.
