- Abstract
The article focuses on the privacy rights of employees outside the workplace and the constitutional, statutory and common law perspective for the identification of privacy rights in context of employment relationship. Topics discussed include employer wants to limit exposure to criminal and civil sanctions for violating the privacy rights, laws such as Health Insurance Portability and Accountability Act of 1996 and Privacy Act of 1974 and concerns related to invasion of privacy tort.
