The article discusses the business ownership case including the intellectual property, power of brand and social media of Penguin Drive-in restaurant in Charlotte, North Carolina. It notes that the restaurant begun as an ice cream shop in 1954 and was closed following the retirement of its owner Jim Ballentine in 2000. It states that local residents Jimmy King and Brian Rowe approached the family to reopen the bar and were offered by a franchise causing conflicts as to who owns the brand name.
