- Title
SORRELL V. IMS HEALTH AND THE END OF THE CONSTITUTIONAL DOUBLE STANDARD.
- Authors
Young, Ernest A.
- Abstract
An essay on the U.S. Supreme Court's ruling in the 2011 case Sorrell v. IMS Health Inc. is presented. It states that economic developments have continually worked to erode personal privacy and freedom of speech rights. In Sorrell, Vermont's statutory regulation banning the sale or disclosure of the pharmacy records which reveal the prescribing habits of physicians was challenged. The concept of data mining, in relation to private medical information, is also addressed.
