- Abstract
The article examines the federalism and capital punishment prevailing under Supremacy Clause arguments of the U.S federal criminal jurisdiction. It informs about the changes in the U.S. Department of Justice's Death Penalty Protocol (DPP) and depicts the major policy advantages of capital charges made by federal authorities in case of abolitionist states. It discusses the U.S. court case United States v. Jacques, wherein the defendant was charged of kidnapping.
