- Title
MASS TORT ETHICS: WHAT CAN WE LEARN FROM THE CASE AGAINST STANLEY CHESLEY?
- Authors
Scheuerman, Sheila B.
- Abstract
An essay is presented on the court case Kentucky Bar Association v. Chesley in which the Supreme Court of Kentucky disbarred Chesley for violating the ethics rules on fees and aggregate settlements. It discusses three lessons for all mass tort lawyers including the plaintiffs' attorney having an attorney-client relationship in a non-class action mass tort, non-treatment of mass tort as a class action and assumption of joint responsibility. It suggests the limitations on settlements.
