- Abstract
Throughout the 21st century’s second decade, several legal dispositions have been approved by Latin American countries to welcome and protect people forced to flee from their countries due to environmental and climatic causes. Despite their diversity, all these measures are framed within the complementary protection category. Consequently, these mandates are based on humanitarian considerations, provide only temporary protection and, to a great extent, depend on the States’ discretional will. This paper aims to open the debate on the recognition of these forced migrants as refugees, which would allow them to be guaranteed a broader and more stable set of rights. In order to do so, the Cartagena Declaration’s current interpretation will be challenged, according to witch only human acts can give rise to international protection.
