- Abstract
The article investigates the maintenance rates for U.S. patents protecting biologics and small molecules approved by the U.S. Food and Drug Administration (FDA). Of the 146 unique biologics patents that protect 43 products, maintenance fees have all been paid save for five items. Of those with paid fees, 95 percent have matured to reach the 8-year window. For small molecule patents, 34 percent of 1,833 patents have expired due to nonpayment.
