- Abstract
The article focuses on reverse mortgage regulation and its structure in the U.S. It explores the ways in which courts have applied federal and state law to claims brought by non-borrowing spouses after the demise of the borrower. It recommends invalidation of current federal regulatory provisions and promulgation of new regulations in order to reflect the intentions of the U.S. Congress accurately. Topics include chevron test, home equity conversion mortgages, and title 12 of the U.S. Code.
