- Abstract
The European Court of Justice (ECJ) has ruled that information on out-of-court dispute resolution must be included in the credit agreement itself. This corresponds to the goal of the EU Consumer Credit Directive to provide consumers with quick and comprehensive information about initiating an out-of-court procedure. Previously, some banks referred to a procedure regulation or another document that could be accessed on the internet. However, the ECJ has determined that this is not sufficient. The ECJ's decision contradicts the opinion of the Federal Court of Justice (BGH), which clearly rejected the question as being in conformity with the directive.
