- Abstract
The Italian Supreme Court has ruled that employees are entitled to receive their full salary, including all components normally paid, during holidays. This decision aligns with the judgments of the European Court of Justice (ECJ) and the purpose of the Working Time Directive. The court emphasized that any decrease in salary during holidays would discourage employees from taking annual leave, which goes against European rules. The Supreme Court also confirmed that the decisions of the ECJ have binding effect on national courts, which must interpret national legislation in compliance with European legislation.
