- Abstract
An essay is presented on a pivotal moment in conservative majoritarianism from 1982 to 1987 following U.S. federal judge Brevard Hand's rulings in the Mobile, Alabama cases Jaffree v. Board and Smith v. Board. Topics covered include a community dispute over religious content in public schools, religious majorities' co-opting of case law to advance their claims, and the increasing willingness of conservatives to accept the judiciary's commitment to the protection of First Amendment rights.
