- Abstract
Although in the history of Mexico there has been strong tension in the relationship between artisans and designers, it was not until recently that cases of exploitation were made visible which resulted, among other things, in the Federal Law for the Protection of the Cultural Heritage of Indigenous and Afro-Mexican Peoples and Communities. Although the legislation and the visibility of the problem represent an advance towards the construction of more horizontal relationships between artisans and designers, there is still much to reflect on and understand about the edges that make the problem up. Thus, the objective of this paper is to address the following questions: what is the origin of this unequal relationship between artisans and designers in Mexico? How is it currently described? And, what contributions can this law make in this regard? For the above, the methodology proposed for this work implies a necessary interdisciplinary dialogue between design, anthropology and law, enunciated in a brief description of two different cases in which important aspects of this relationship are shown: one in the past --described through bibliographical research-- and another in the present --to which testimonies obtained through ethnographic fieldwork are added. One involves an indigenous population and the other does not. Then they were linked to the analysis of the afore mentioned legislation. From this process, it was found that the tension between artisans and designers has occurred since the practice of design in Mexico became a profession. This happens while trying to consolidate laws and public policies that seek to regulate practices which, from their origin, have been considered unequal. The conclusion highlights some central keys for a more horizontal relationship between the design sector and the artisan sector.
