- Abstract
The article focuses on finding a common law right of action for wrongful death by sympathetic courts through Ronald Dworkin's theory of adjudication. Topics include need to recognize such rights, cases upholding and denying the common law existence of a wrongful death claim, and use of the theory to recognize the common law cause of action for wrongful death, and the judicial application of the theory in the suits of wrongful death.
